Terms of Service

1. Services

806 Growth provides digital marketing services including (but not limited to) AI voice answering, AI chat setup, missed-call text-back, review automation, local SEO, content, and paid ads management. Specifics for your account are defined in your signed engagement letter.

2. Agreements

All monthly plans are 6-month agreements. After the initial term you can cancel anytime with 30 days written notice. There are no early-termination fees or long-term lock-ins. The System Buildout is a one-time fee and never auto-renews.

3. Payment

Monthly fees are billed in advance on the day you signed up each month. System Buildout is billed once at start. Failed or late payments may result in service pause; we'll email you first.

4. Your responsibilities

• Provide accurate business information, access credentials we need, and timely feedback.
• Comply with platform rules (Google, Meta, etc.) and applicable law (TCPA, CAN-SPAM, etc.) when sending marketing.
• Own the content you give us to publish on your behalf.

5. Our responsibilities

• Deliver the services in your engagement letter, on time and to professional standards.
• Communicate clearly. Tell you the truth — even when it's uncomfortable.
• Keep your data safe per our Privacy Policy.

6. 30-Day Lead Recovery Guarantee

Once tracking is installed, every eligible missed or after-hours lead gets an instant response. If we fail to deploy the agreed workflow in the first 30 days, your second month is free. Beyond that, marketing results vary by industry, market, offer, and execution. We do not guarantee specific revenue, ranking, or traffic outcomes. We do guarantee that we'll do the work, report on it transparently, and adjust when something isn't working.

7. Intellectual property

Content we create specifically for your business (ad copy, posts, audit reports, voice agent prompts) belongs to you once paid for. Templates, frameworks, and proprietary tools we develop remain ours.

8. Limitation of liability

To the maximum extent allowed by law, our total liability for any claim is limited to the fees you paid us in the prior 3 months.

9. Governing law

These terms are governed by the laws of the State of Texas. Any disputes will be resolved in Lubbock County, TX.

10. Updates

If we change these terms, we'll update the date and (for material changes) notify active clients directly.

11. SMS / Text Messaging Terms

Consent. By providing your mobile number through a form on 806growth.com and submitting that form with the SMS-consent acknowledgment, you give express written consent for 806 Growth to send recurring transactional and marketing text messages to that number, including via automated dialing systems. Consent is not a condition of purchase.

Message categories. Audit results, demo and appointment scheduling, lead follow-up, service updates, and occasional promotional content related to 806 Growth services.

Frequency. Message frequency varies based on your activity and our outreach.

Charges. Standard message and data rates may apply per your carrier plan. 806 Growth does not charge for SMS.

Opting out. Reply STOP to any message to unsubscribe. We will confirm and cease further messages.

Carriers. Supported by major US carriers. Carriers are not liable for delayed or undelivered messages.

Changes. We may update these SMS terms; continued participation after notice constitutes acceptance.
